These Terms of Service govern your use of peacockpowder.com (the "Site") and your purchases from Oil Chaser LLC, doing business as Peacock Powder ("Peacock Powder", "we", "us"). By using the Site or placing an order you agree to these terms.

1. Who can order

You must be at least 18, or the age of majority where you live, to place an order. If you order on behalf of a school, PTA, church, company or other organization, you confirm you are authorized to do so.

2. Products and use

Our color powder is cornstarch-based and made for outdoor events. It is not food and is not intended to be eaten. Use it as described on our Safety Data Sheet page, keep it away from open flames and ignition sources, and supervise children. Colors on screen may differ slightly from the actual product.

3. Prices and volume pricing

Prices are in US dollars and may change without notice. Volume pricing is applied automatically in the cart based on the number of bags ordered. We may correct pricing or typographical errors and may cancel an order affected by one, with a full refund.

4. Orders and payment

Your order is an offer to buy, which we accept when we ship it. We may refuse or cancel any order, including orders that appear to be for resale. Purchase orders and Net-30 invoicing are available to organizations; invoices are due within 30 days.

5. Shipping

Shipping terms are set out in our Shipping Policy. Risk of loss passes to you on delivery to the carrier.

6. Returns and refunds

All sales are final. Damaged, defective or incorrect orders are handled under our Refund Policy.

7. Reviews and feedback

If you submit a review, photo, idea or other feedback, you allow us to use, edit and publish it in connection with our business without payment to you. Do not submit anything unlawful, misleading or that infringes someone else's rights.

8. Acceptable use

You may not use the Site for any unlawful purpose, interfere with its operation or security, scrape or copy it, or submit false information.

9. Third-party services

The Site uses third-party services such as Shopify, payment processors and carriers. Their own terms apply to your use of them, and we are not responsible for their acts or omissions.

10. Disclaimer of warranties

Except as stated in these terms and our Refund Policy, the Site and our products are provided "as is" and "as available", without warranties of any kind, express or implied, to the fullest extent the law allows.

11. Limitation of liability

To the fullest extent the law allows, Peacock Powder is not liable for any indirect, incidental, special or consequential damages, and our total liability for any claim related to an order will not exceed the amount you paid for that order.

12. Indemnification

You agree to indemnify and hold Peacock Powder harmless from claims arising from your breach of these terms or your misuse of our products.

13. Governing law

These terms are governed by the laws of the State of Utah. Any dispute will be resolved in the state or federal courts located in Salt Lake County, Utah.

14. Changes

We may update these terms from time to time. The version posted on the Site when you place an order applies to that order.
